1. General
Due to the nature of creative and digital services, all fees paid to JadiMedia are subject to the terms outlined below. This policy applies to all projects, retainers, and service agreements regardless of the payment method or payment schedule used. Partial payments, instalment payments, and split payments are all subject to the same terms as full upfront payments.
2. Project Confirmation and Commencement
A project is considered confirmed and commenced upon receipt of the first payment, regardless of the amount. From the moment the first payment is received, JadiMedia allocates resources, time, and capacity to the client's project. No minimum payment threshold is required for a project to be considered active.
3. Deposit Refund Window
The initial payment or deposit is refundable only if the client submits a written cancellation request to business@jadimedia.ch within 7 calendar days of the first payment, and only if no work of any kind has commenced during that period. If any work has commenced within the 7-day window, the payment is non-refundable from the moment work begins, regardless of how many days have passed since payment. After the 7-day window has passed, all payments made to JadiMedia are strictly non-refundable under any circumstances.
4. Instalment and Split Payments
Where a client chooses or agrees to pay in instalments or multiple partial payments, each individual payment is subject to the same refund terms as a single upfront payment. The splitting of payments into smaller amounts does not alter, extend, or reset the refund window. All payments made, regardless of amount or frequency, are considered part of the total project fee and are non-refundable once work has commenced.
5. Delivery Timeline
JadiMedia agrees to deliver projects within the timeline specified in the project proposal or service agreement. The delivery timeline begins from the date of the first payment or the date of written project confirmation, whichever comes first. JadiMedia is not considered in breach of the agreement and no refund is applicable until the agreed delivery deadline has passed without delivery and without prior written communication from JadiMedia explaining the delay. A client may not request a refund on the basis that the project has not yet been delivered if the agreed delivery deadline has not yet passed. Requesting a refund before the deadline is not a valid ground for cancellation or dispute.
6. Client-Side Delays
If the client fails to provide required materials, content, feedback, approvals, or access in a timely manner, the delivery timeline will be extended accordingly. JadiMedia is not liable for delays caused by the client and no refund is applicable in such circumstances. Delays caused by the client do not constitute a breach of the agreement by JadiMedia.
7. Cancellation After Work Has Commenced
If a client cancels a project after work has commenced and beyond the 7-day refund window, the following applies: All payments made to date are non-refundable. JadiMedia will calculate the total value of work completed up to the cancellation date based on the agreed project scope and rate. If the value of completed work exceeds the total amount paid, the client will be invoiced for the outstanding balance. If the value of completed work is less than the total amount paid, no refund will be issued for the difference. All deliverables and work product created up to the point of cancellation remain the intellectual property of JadiMedia until the full project fee has been paid in its entirety.
8. Completed and Approved Deliverables
No refunds are issued for deliverables that have been delivered and approved by the client. Approval is defined as any written confirmation including email, WhatsApp, or any other written or digital communication. Silence for more than 7 days following delivery of a deliverable is also considered implicit approval.
9. Retainer Agreements
Monthly retainer fees are non-refundable once the billing period has commenced. All retainer agreements require 14 days written notice to cancel, effective at the end of the current billing cycle. No partial refunds are issued for unused days within an active billing period.
10. Advertising and Third-Party Ad Spend
Ad spend paid directly to third-party platforms including Meta, Google, TikTok, and YouTube is entirely separate from JadiMedia's management fee. JadiMedia has no control over and accepts no liability for funds held by or paid to any third-party advertising platform. All refund requests related to ad spend must be directed to the respective platform. JadiMedia does not refund, reimburse, or compensate for any ad spend under any circumstances.
11. No Goodwill Refunds
JadiMedia does not issue goodwill refunds, partial refunds outside the terms stated above, or refunds based on subjective dissatisfaction with creative direction that was previously approved by the client. All creative decisions are made collaboratively and require written client sign-off before proceeding. Dissatisfaction with a final deliverable does not constitute grounds for a refund if the deliverable matches the agreed scope and previously approved direction.
12. Force Majeure
JadiMedia shall not be liable for any delay or failure to deliver caused by circumstances beyond our reasonable control including but not limited to illness, technical failures, natural disasters, or platform outages. In such cases the delivery timeline will be extended and no refund will be applicable.
14. Disputes
Any disputes regarding payments or deliverables must be raised in writing to business@jadimedia.ch within 7 days of the disputed invoice or delivery date. JadiMedia is committed to resolving all disputes fairly and professionally in accordance with Swiss law. Disputes raised after 7 days of the invoice or delivery date will not be considered valid.
15. Governing Law
This refund policy is governed by Swiss law. Any disputes arising from or in connection with this policy shall be subject to the exclusive jurisdiction of the courts of the Canton of Zurich, Switzerland.
